This is the kind of thing everyone hates about the courts. The court found the methodology was flawed, the FCC made assumptions (that are now clearly wrong), and the FCC didn't actually listen to any of the feedback it received concerning the topic, yet somehow it was ok for them to do what they did. I guess this why there are appeals.

It's a method of "throwing something at the wall to see if it sticks"

So some yahoo who disagreed with what the FCC did asked a group of unelected judges to substitute their judgement for the FCCs.

It is good that he lost. Self-appointed groups that file suits like this should pay the taxpayers’ costs, to discourage this behavior.

It was Mozilla Corp., not Yahoo who sued. ;)
