Cable Dispute to Hit Sports Fans

About 2.4 million Time Warner Cable customers in the New York metropolitan area were expected to lose access to Knicks games and Mets preseason games at midnight yesterday because of a pricing dispute with Cablevision, which owns the MSG Network and Fox Sports New York.

In a statement from MSG Networks, which oversees MSG and FSNY, the company said, "Time Warner has declined our offer to keep games on while we bring the dispute to an arbitrator." Time Warner has suggested nonbinding mediation.

MSG accused Time Warner of having "pulled the plug" on the networks. But Mark Harrad, a spokesman for Time Warner Cable, said the company was told by letter on Friday by Mike Bair, president of MSG Networks, that carrying the two channels past midnight would constitute copyright infringement.

Time Warner has carried the Cablevision networks' games without a contract since the start of 2004; since August, Eliot Spitzer, the New York attorney general, has brokered three extensions.

They are about 20 percent apart on an agreement on the monthly price of carrying MSG, FSNY and Metro channels, much as they were last summer. Harrad said, "We don't feel they've ever budged."

The two companies dispute the value of the Cablevision channels, which have lost the rights to the Yankees and the Nets, and will lose the Mets after this season. Time Warner said it would give $2 monthly rebates to customers for the loss of the channels, and replace MSG and Fox with the NBA TV and CSTV channels.

These carriage skirmishes go on all the time. CVC has no monopoly on that sort of thing. Our local FOX affiliate was holding out against Comcast right up until the final days before the Super Bowl in the same sort of pricing dispute. We had the SD channel, but Comcast wasn't carrying the HD feed until late negotiations brought a resolution.

I'm sure both sides didn't want the bad press of a local market the size of the SF Bay Area missing the Super Bowl in HD. Think of all those new sets and irate owners who would have lit up the phone lines ;)
