And yet noone has pondered what happens in the event E* splits in two, and which side of it the lawsuit then applies to.

You don't sue a "division" of a company, you sue the parent company. Technically, it would be the hardware side, i.e. Echostar, not Dish Network, but it's still the parent company that is sued. The split doesn't really affect the lawsuit anyway.
