Right, not so sure that he can hang onto bandwidth indefinitely courtesy of bankruptcy. I would bet the auction terms carried provision not to be able to hang onto it through BK if failing to meet utilization requirements. As the original owner of the spectrum, the Government would have rights to how it is used. The issue is, that is already in the paper work. Echostar/Dish needed to expand mobile service out to x% of the people by certain deadlines. Based on the comments from the FCC, they are making pleas to Ergen, not enforcing violations Ergen made on the agreement signed onto by buying the spectrum.
