FreeHD Canada news (bad news?)

I came across this while looking for some VoIP related information on CRTC's website:

Looks like it won't be easy for FreeHD Canada to get started.

I wouldn't suggest that this is bad news. This just looks to be another example of a business attempting to use regulation or the courts to strengthen their position.

Appears that this decision only reaffirms that FreeHD negotiates with the bandwith owner, Echostar. I certainly would agree with the CRTC position. The satellite was launched under contract for a specific client, Bell and subsequently sold to Echostar with CRTC approval when a new satellite, Nimiq 6 was contracted. All this transpired before FreeHD applications were submitted.
