Aereo Decision Alert

This is law for you. Honestly, there were a number of ways they could go. Each having a proper "logic" in itself. I turned around my position on it from where SCOTUS ruled after a thorough thread at this forum.

This feels similar to IRS cases, where someone feels they found a perfect loophole. But in the end, the spirit of the law trumps the letter of the law.

A bid by Aereo to be defined as a cable provider gained support from the FCC with a new proposal out this week which was described in a blog post written by Chairman Tom Wheeler.
The agency supports "open access" for consumers to high-speed broadband delivery and the right of over-the-top firms to offer programming owned by pay-TV providers and broadcasters.
In essence, the FCC thinks the bundled pay-TV model should be broken so that consumers will not be forced to pay for channels they never watch.

So the FCC didn't back Aereo then... and their business model wouldn't work because it hinged on selling a product the courts view, they didn't have appropriate rights to. Aereo prices would go up quite a bit if they had to pay for the channels they distributed.
