It seems like not to long ago, I posted a message abut DIRECTV suing DISH Network over it's ads.

Now the shoes is on the other foot. DISH is suing DIRECTV over it's ads including the new To Tell The Truth Ads.

DISH Networks lawsuit is attached below...

Your thoughts please.

Dish brings up many good points, but seems to forget they have a similarly slanted ad campaign themselves. I wish both sides would grow up and shut up!

Who cares? Maybe some Dish stock holders. Since this is a DTV forum, why would anyone care here unless they were lawyers who wanted a piece of this pie?

Last month DIRECTV sued DISH for the same thing... So I would say its relevant here in the DIRECTV forum.

The truth went it comes to pay TV is far from black and white.......especially with these guys. These lawsuits are a waste of the court's time....

I think they should both learn to get along and merge.

How about Dish Direc

Or Direc Dish

for possible names?!?

Seriously though just more frivolous lawsuits on the part of Dish Network, following equally frivolous lawsuits on DirecTV's part.

Both parties should focus on acquiring cable subs and unserved rural areas that dont even have locals. They are just swapping each others subs with this campaign. Both providers are good--now go beat up the cable operators.

I doubt these suits make any sense from a business perspective. If someone feels fraud is being committed then contact the FTC ( trade commission). Meanwhile its all about advertising and most people are not stupid enough to jump ship over the claims in these ads. At least not enough to get a good ROI on the suits and ad costs.
Furthermore, I don't even watch the damn 30 second spots. Not even on the Superbowl. It's why I have a dirty spot over my 30 second skip ahead key on the remote. Having been in the business of creating commercials for 20 some years, I know all these things try to do is plant top of the mind awareness, a form of brain washing.

Look at the filing closely, this is not a separate suit filed by DISH.

This is DISH's response to Direct's allegations in the original suit filing (Direct vs Dish) with a counter claim attached by DISH.

This is very common in legal filings.

Instead of typing the same thing over that I typed in this same thread on the Dish side, I will simply cut and paste what I typed:

Just like when Direct sued Dish, this should not be brought to the courts. Let them fight it out in the market, like they have been doing.

I said all along that the best thing for Direct to do was to fire back at Dish with their commercials, and now I will say the same about Dish. The best thing for them to do is to fire back at Direct with commercials of their own.

A good example is the current DirecTV, "To Tell The Truth" commercial where Direct claims to have more full time HD Channels. This is true when you count PPV and RSNs. What Dish should do is something similar to what Direct is doing to counter Dish's "Same TV for Less" claim; Dish should simply do a commercial listing all of the HD channels that they have that Direct does not. This alone will be effective and counter DirecTV's "More full time HD" claim.

The "truth" is neither Dish or Direct tell the truth to their customers. Does anyone believe if either Dish or Direct would disappear tomorrow the customers' bills would go down? This is just a battle of billionaires and their shareholders for all the marbles and we get to foot the legal bills to boot. A pox on both your houses!

You would think that dish would fire back that 30 of directv's full time HD channels are Pay per view, meaning you have to pay extra in order to view them. Even then its not on a full time basis!
