They are on Cband, As to what condition, I dont know, But I think they are encrypted. I do know that they require a 12 footer to get them reliably though as they are in s2.

What I mean to say is oviously someone had to authorize the recievers Dish uses to get those channels before sending them to us. It seems odd to say so much later that Dish simply is not authorized to distribute these channels.

Dish could remove every single channel from their line up and there is NOTHING you could do about it.

Don't like it? Don't sign the contracts and pay the equipment fees up front.

Not that I disagree with your overall point, but technically, there is nothing in the language you quoted from the service agreement that makes reference to the right to terminate without paying a cancellation fee. It only speaks to the right to obtain a refund.

I would guess it is probably addressed in another section of the service agerement, but if you're going to advise him to read the agreement in such emphatic fashion, you should probably point him to the correct provision.

And if they did remove all the channels as you suggest in your post, there would be several legal remedies available to subscribers.

Effective June 22, 2010 the standard-definition feeds of Disney Channel, Disney XD, ABC Family and ESPNews are still available, and you may continue to watch your favorite programs on their regular channel numbers.

DISH Network offers all customers HD Free for Life, which is possible because we are committed to negotiating fair contracts that allow us to keep our prices low. That is why we could not agree to the significant fees required by Disney and ESPN Networks for the HD feeds of Disney East, Disney XD, ESPNews and ABC Family. After we refused to pay, Disney and ESPN Networks pulled the HD feeds of these four channels only.

DISH Network is pursuing every avenue possible to restore the HD feeds of these channels. We apologize for any inconvenience and we thank you for being a valued DISH Network Retailer.
 
Keep them all off the dish. They are nothing but infomercials with an occasional break for programming. Who needs them? As someone mentioned before get the kids doing something active. If a child is young enough to be watching Handy Manny they don't care if it is in HD or SD. As to the ESPN channels, don't you get sick of all the hype and screaming. Come on, there is rarely any sports on there. Even when they are telecasting a game there is too much extraneous BS coming from the so so called experts you have to turn off the sound to enjoy it.:p Take the time to check out some of the channels you don't presently watch, You may find something that you like.
 
Can someone help me understand this suit? It sounds to me like Disney is saying Dish never had a right to carry them in HD. But (correct me if I'm wrong) those channels are not distributed on C-band FTA. Obviously at some point they gave Dish access to them, and if there was no agreement, how had Dish carried them for over a year.

Yes this is the puzzler. I suspect the basic E*-Disney programming contract in effect, failed to differentiate between SD and HD content and thus E* felt free to use both SD and HD content instead of negotiating a separate contract. Now Disney has stuck out its horns in order to grab more bucks from distributors in getting courts to decide that SD and HD programming are different products. I've been looking for the case but haven't located it yet, so I'm just speculating. E* probably isn't feeling a lot of love for Disney/ESPN anyway as ESPN screwed them over and violated the most favored clause of the contract.

Time Warner Cable is the same size as Dish Network, and is the #2 cable company in the US.

Comcast wich is the number 1 provider hasnt had a dispute like this.

So no ESPNewsHD now as well. I've lost 2 local HD's as well this past week (Springfield, MA). The a la carte idea is great... I would pay extra for channels rather than having them pulled. The bickering about what channels are important and of most value would end, we could pick what's wanted. That won't happen though due to the providers contractually insisting that they're in a package. Irregardless of whom is at fault, this will be resolved quickly or I will leave DN. My programming package is going from top250 to the lowest available package until this is resolved. I've said my piece here, now I'm off to say it with my pocket book. :(
 
I figured Vurbano would chime in with his sarcasm. The only one missing from this conversation is Haller. The only channel I care about is Disney HD since my daughters channels are limited on Absolute and the SD versions aren't available.
 
Disney east and abc family hd and sd have been removed from the Dish America package. Our family will be missing both. Wish the welcome package was still available, we would shift to it for the time being.
