I've just saw this @ endgaget today: TiVo and DISH / Echostar head back to Texas for another patent duel - Engadget

Looks like this will never end...it will be bad if dish loses again, it will just hurt customers.

There was no earlier settlement. Rim thought there was. They were wrong.

RIM just can't catch a break. Following ruling after ruling against the Blackberry manufacturer, a federal judge has now decided that the disputed $450 million settlement with NTP that RIM was looking to have enforced is not in fact valid. District Judge James Spencer could next decide to reissue an injunction that would suspend Blackberry service in the US, which might effectively force RIM to cough up as much as $1 billion to avoid. All of this action comes while the validity of NTP's original patents is still in question, but that is still an issue for the Patent Office and thus has no bearing on the current proceedings.

BTW, there was also this "wild claim" that it could have cost RIM as much as $1 billion if RIM did not settle, was this how some of the TiVo folks came up with the $500M E* would have to pay if they did not settle?

TiVo did not even make a real effort to prove E*'s new design continues to infringe. Keep in mind for TiVo as the "mover" in this contempt proceeding to actually prove a contempt, TiVo must prove by clear and convincing evidence that the new design is still an infringement. The burden of proof in this situation is actually higher than during the jury trial.

TiVo isn't even trying this time around, do you know why? They can't, E* made those changes and TiVo themselves cannot deny such changes.

All TiVo has been able to do is to say, but E* violated the injunction "on the face", or E*'s new design still "parses"

Rim had to start over and try to work out an agreement. NTP had no claim to a single centavo of settlement money until the settlement was reached. The settlement amount was $612.5 million and every penny was given to NTP on 3-3-06.

And applying RIM case to this case how? Why avoid the real issues here? TiVo has no case on the contempt issue, that is why after 11 months into the contempt proceeding, they still got nothing.

E* only lost to TiVo once, that was three years ago, right after that loss, E*, D* and TW were sued by Forgent for a similar DVR patent infringement, as I said earlier, D* and TW chickened out at the last minute and settled with Forgent for $8M and $20M each, only to find out a few weeks later E* had thrown Forgent out on the curb, that was right after E* lost to TiVo back then, and Charlie relied on the same lawyers to win that Forgent case for him, talk about having the faith and guts.

Dish's strategy is probably to try to litigate this until the patents expire or TiVo agrees to a one time licensing fee... There is no incentive for Dish to ever give in to TiVo after it has gone this far. May as well keep appealing and dragging it out as long as possible.

E* needs to get (1) either get a ruling that its DVRs no longer infringe or (2) litigate with Tivo to the point where Charlie can buy it. Either way, Charlie gets to market his hardware to other segments of the industry.

I was thinking...instead of a licensing agreement, I wonder if E* and Tivo will enter into a partnership? EchoStar could make the hardware and Tivo could brand and market this digital cable ready version of the EchoStar's 922. This would be a killer machine if they could merge all the Tivo HD, VIP Series and Sling features into one box. Additionally, there could be two version of this 922/Series X box: a cable tuner only model for Cable MSO sales, and a two cable tuner/two OTA tuner model for the direct-to-consumer sales. Having been a E* customer for almost three years and after having used a Tivo HD with FiOS TV the past couple months, I would love to see this happen.

I don't know about you, but this sould like a win-win-win situation that could actually help Dish Network add and retain customers.

Cable systems and sat systems use entirely different technolgies. It is highly unlikely to be able to combine all these you you want. They just are not compatible. It would be totally different guts for both machines. You area also bringing in a 3rd totally different technology when you ask about FIOS as well. so you are looking a 3 different boxes here.

You do realize that EchoStar currently makes Cable products (Sling Modem), licenses Tru2Way cable technology, has been trying to reach set-top-box agreements with Cable MSOs for almost a year, and have announced they will be making a "Cable" version of the 922 available to the Cable community this spring? EchoStar is wanting to get into the Cable set-top-box market and a partnership with Tivo may be the "only way" they will get there. Anyway, I've provided links for your reading pleasure.

In the legal context, E* does not have to do anything, as long as the judge does not order E* to turn off the DVR functions. Everything else is hot air.

That is the scenario I am rooting for.

One exchange from the recent hearing that is in the minutes shows the judge urging the parties to settle. The TiVo attorney replied that they were open to it, Ergen only replied with a maybe. So I think Vampz26 assessment of Dish's mindset is currently closest to the mark. Settlement does not seem to be on Dish's current agenda.

Technically, the box for cable needs to have cable tuners which differ from satellite tuners. The rest could be very similar and the user interface would probably be almost identical. That box could be the basis for cable and FIOS products, since they both work the same.

The battle is counter productive for all, let's hope it ends well.

Dish Anywhere Questions

I just heard about this Dish Anywhere. I have a Hopper in the living room, a Joey in the basement, and antenna tv in the bed room. As I understand it I can get rid of my Joey I could save a few bucks but that tv and the bedroom tv are not smart tv's. How would I handle that? If with a Firestick what remote would I use or would I have to use 2 of them? I have good internet with starlink so wifi wouldn't be a problem. If someone could guide me to a link that a old man could understand I would appreciate it.

Rambling about picture quality.

Satellite channels with the Joey 4 look better on the old 65 LG oled than with the Hopper 3 on the newer Sony 77 oled.

I don't have a Hopper Plus.

Maybe the satellite picture quality with the Hopper Plus would be better than the Hopper 3 satellite box?

Trying streaming from Dish Anywhere app to see if the stream is better than sat.

Picture using Dish Anywhere on my latest Apple TV 4K box on the channel I'm watching started out alternating between fuzzy and clear.

The picture stabilized after a few minutes.

I have an old Apple TV HD connected to and big older TV.

I had to remove Dish Anywhere application and reinstall it to get it working on the old TV with the Apple TV HD.

I hooked up a Google box to a non oled 43 inch LG 4K set.

The Google box Dish Anywhere combination looks and works great.

Wonder what the picture quality will be with a wireless Joey 4 for the satellite chanels?

The Hopper3 outputs 1080i unless the content requires 1080P or 2160P (4K)
The Plus and the Joey4s upscale all content to 2160P, and also flag the content as HDR regardless of the actual color profile. How the TV will handle that depends on the HDMI setting.

So, it's possible that the difference you are seeing is related to the upscaling performance, or the possible HDR settings on your TV.

we have a 77 inch oled sony our hopper 3 looks amazing on it!! as good as direct would and for the standard def channels it upscales awesome. i wonder if it's something in the tv settings or something going on with the hopper..

we have an LG oled tv in the truck with an apple tv and it looks great to using dish anywhere. the joey 4's are an awesome client!!!

Sony uses LG OLED Display panels but the electronics makes the difference in the processing of the signal.

As for Dish Anywhere, your speed is the full WiFi/Ethernet speed at home so it's giving maximum bandwidth available and should still be good on the iPhone when at home. When you are using an external connection, it is limited by the upload speeds of your internet connection depending what you have. For me, I have 1.4Gbps download but 42Mbps upload and of course DISH Anywhere does not use the full 42Mbps either.

Models change and companies change every year sometimes for the better, sometimes for the worse, but Sony has generally been good.

I think there was a Sony oled one year that used a Samsung panel and may have been great.

I think TCL is going to start making stuff for Sony.

You can get a USB Hub and plug it into one of the rear USB ports and expand on your inputs without using the USB port on the front of your Hopper 3.

sony does use LG panels is correct. and the electronics do make a difference in the processing of the signal wich is also true. though sony also cherry picks the panels to.

I recommend the USB hub be self powered. Gives you options to add unpowered EHDs without concern about stressing your internal power supply.

Umbrella base for pole to fit antenna

I'm still experimenting with OTA antennas at my new apartment. The mudflap works OK, but we had a dust/wind/rain storm the other day and it all but blew it away. I moved it indoors where the antenna is safer but the signals are marginal.

I bought a traditional Yagi antenna from Amazon and it seems to work more consistently, plus it's meant for outdoors where the mudflap is not.

Anyway, I've had success using umbrella bases paired with a fence post for satellite dishes, and I figured that could work for this as well. I'm just not sure where or what to get and what size pole for this application.

My favorite receiver besides the amazing Hopper 3 was the DishPlayer 7200. I loved that thing as buggy as it was. It was the future!

I had both the 7100 and 7200 dishplayer starting in 1999. My first exposure to the internet at my house using the WebTV feature. We loved it till they had a fight between Microsoft and DISH and then I can't remember how many of those damn boxes I ended up replacing till I just gave up and went with a regular receiver again and used it with my VCR.

But then the 501 PVR came out and the 510 and the 522 standard def receiver but it still didn't have name-based recording. Then the 942 receivers were even better with built in ota tuner and name- based recording. Had two of those in 2005. But only 250GB hard drive for like 25 hours of HD recording, but it did have dual room use, like the 722k that came later did.

Didn't they add the NBR at some point to the 50x series? I stayed away from dishplayer and my instincts were right.

DiSH was different in taking its manufacturing in-house, but of course that was its previous Echosphere/Echostar c-band model, since its purchase of HTS. And probably most of the c-band systems they sold were UHF remote.

It looked identical to the 3000 and some were labeled 2200. No IR blaster for the VCR, I can't remember if the 3000 had one or not, the 4000 certainly did.

That may have been reserved to the 5000, if it was available in the early models at all. It was not a 4000 feature as far as I remember. I really first recall it with 4700 (and not 3700).
