I would imagine NPS has researched this fairly throughly knowing full well that there is going to be stiff opposition to this from NAB/Direct. They have to know that lawsuits will be filed. Can't imagine why NPS would take this on if they didn't believe 100% they will make money(lots of money) and they will prevail in court.

And I guess they wanted to get it started right away per the legal filing.
"The scheme is laid out in detail in a letter from Mr. Mountford to counsel for plaintiffs (Exhibit 1 hereto), an email from Mr. Moskowitz to counsel for plaintiffs (Exhibit 2 hereto), and a written contract between EchoStar and NPS (Exhibit 3 hereto)."

Hmm, "mydistantnetworks" from "AllAmericanDirect"...

Doesn't Rupert have a trademark on at least half of those words?:p

Bah! Humbug!! A lease and procurement of services does not a concert make. The provider's name is NPS.
And the uplink centers are owned by Echostar. And the satellite license is owned by Echostar. And the receivers out in the field were all made under Echostar's guidelines. And the satellite is owned by Echostar. Simply by leasing out a transponder only to retransmit distant network to a third party does make an "in concert" agreement.

Don't worry, everyone. I'll be right about this one, as well.

Funny.

And Dish Network for the past nine years believed they would prevail in court. :)

Greg what are you smoking?

If your theory is correct then what about SkyAngel which opperates the same way? Again SkyAngel could start offering Distants tommorow as well if they wanted to.

Welcome!

No at the moment All American Direct does not offer HD locals (or distants).

I do believe that if you qualify you could still get CBS HD from Dish Network.

Greg, just a quick question? What is the difference between Skyangel and NPS's arrangements with Dish. Are you saying that SA also could not provide or add distants networks with their programming packages?

Charlie's playing it smart. Not mentioning NBS directly to any of the retailers. Make NBS sound like a competitor.

Greg,

Another thought is think of this like DirecTV and USSB, both were two seperate companies that had the same uplink, and used the same technology and hardware.

Think of NPS as USSB, they are seperate from Dish Network yet like USSB they use the same uplink center, technology and equipment. You bill for service comes from NPS not Dish Network.

Its the same exact thing.
