New voom box and OTA?

If I order a NEW voom receiver on e-bay, can I still use it for OTA only without getting a software download via the satellite?
 
Box has to be activated at least once before you can get access to the menus that allow you to scan for locals/OTA.

I've heard if the box has been activated before, then it should work. I've also heard that the box has to be currently active to still work with OTA. My best bet would be to see if an Ebayer is selling a box that is still active and is confirmed by them to get OTA. Don't get one of those who says "Oh yeah, I think it does OTA but I can't test it." If they cannot simply hook the box up for a minute or two and check it, then they don't really care.
 
Or they dont' have an OTA antenna. A basic set of bunny ears doesn't cut it.

I loaned a friend one of my recievers so he can play with the OTA and his antenna wouldnt' work. I brought over the antenna that came with my ATI HDWonder card and we were watching OTA HD.

For the record, all three of my boxes are leased and all three still work fine for OTA.
