Wow. I missed all this. Guess I should open more than the standard forums I always read.

Not sure there is anything I can do, but I am in the Columbus area. With the holidays near, I'll be in WV during the weekends, but drop me a line if there is anything I can do as a local.

The local authorities have been contacting me and the last time the guy said that they were not going to bring him over here to serve him over $150. He done this on purpose knowing that he was going to get away with it. The people he targeted were spread out over too large of an area for anything to be done about it. It would cost more to sue than its worth and he knows this. He got away scott free (no pun intended).
 
Not if he sold these "personally". And what would a class-action suit do ? This involves what, a thousand dollars ? The local authorities aren't even being "bothered" with this, so why would a lawyer ? You can't take what he doesn't have ($$$).
 
There is more to this story then we have posted here which has the feds looking into this. It seems as though the UPS account Mr Irwin was using was not his own and he was not authorized to use it.

This is the second time he has gotten caught using UPS accounts that were not his, in fact I believe he was arrested once for this.

For those who were ripped off you can file a lawsuit aganst Mr Irwin in your local small claims court, even if he is not in your state. Also because he lived at home with his parents at the time you can also go after them.

Where ? Franklin Co court records show NOTHING against him like this. Also, UPS will prosecute him in the locations that the "stolen" account belonged to. It's not a federal case.

Please don't spread this.... It's 100% false unless they were "involved" in what he was doing. People believe what you say and this is just false. He's an adult and where he lives has NO bearing. If he were under 18 at the time, then yes, his parent in fact are just as responsible as he is, but he's in his early 20s, I believe.
 
But you can file a claim in your local small claims court. Since you were involved in the transation either jurisdiction is valid to file the claim.
 
Doesn't that cost money to file that claim? Just more money down the toilet for something you will never get. No wonder why so much crime like this goes on, people get away with it without consequence.
 
I think if he operated out of his parents house you can sue them and you should. This may be the most effective way of ending his crimes. Odds are he used their internet service, phone, address and etc to commit the crimes.
 
I don't think his parents can be sued if he is 18 years old or older. If they knew what he was doing though could they then be sued? Could that be considered aiding and abading?
 
Knowing what he was doing is one thing. Helping him do it is a different matter and if they did, maybe, just maybe, can they also be held liable.
 
It's possible that they knew wich if they did and didnt contact the authorities would constitute aiding and abeding aswell and potentialy receiving stolen goods if they were stolen wich opens a can of worms for those here who have bought stuff from him. Im not sure what laws he would have broken by using paypal and an internet connection but if he was using a net account thats under his parents name would also be another problem for them as well and then theres the use of bank accounts other than his. Im just speculating as I dont know enough about any of this but maybe its food for thought, asking about a class action was a question and thanks for the answer.

I'm not sure where the definition of knowing someone is doing something wrong and "aiding and abetting" lies.... I still think it's a stretch.

Just to repeat, the local authorities are showing very little to no interest. I feel sorry for the people who've been ripped off and if it were me, I'd be pissed too. I'd also be pissed that the police aren't doing anything but I also understand from their standpoint. I had a lawnmower and weed trimmer stolen a few years ago ($300-400 .... push mower, gas trimmer) and had to file the police report over the phone. The police do NOT come out for this. I also joked and said "you guys aren't going to look for my mower, are you?" and he said "no, we don't have the resources". He did say if I had the serial # and they found them, I'd get them back but the odds of that are pretty low too. I didn't file a homeowner's claim.

Heh. They have plenty of resources to harrass people about speeding and kids with trucks that are too low, don't they? Meanwhile, the real crooks are roaming free. :eek:

I, too, have had stuff stolen and got no satisfaction from the police. They are pretty much worthless, IMO.
 
This just goes to show that our tax dollars do not go as far as some people think. Maybe the real scam is the law in that it allows people to get away with things such as this. I am sure after others have read this thread that others will now also know what they can get away with and know how to go about ripping others off. I've been ripped more this year than I ever have been in the past. This has not been a very good year as a result. I think more and more people than ever are making a living (or at least part of a living) ripping people off.
 
No your tax dollars dont go far considering that the local police in many area's are making $35G or less a year. Sunday night someone was shooting off a semi auto within a couple of houses distance from ours, I called the police and when they came out they said there was nothing that they could do even though I made it clear to them where it was coming from at one of two locations. The officer gave me a story of chasing down the sounds of someone shooting off a gun 3 miles away from a disturbance call they had at one time yet here I am pointing him in the direction of two homes that not only myself but two other neighbors heard it coming from and they didnt want to do anything.
 
Nobody asked for proof, just said they would not bring him here for $150, not enough complaints in the area to pursue the matter.
 
$35K is too much to spend on low grade morons who sit around eating donuts all day. The cops in Tunica, Ms still have not figured out who cut the old lady's throat at the antique shop across the street from the police station. That happened in the middle of the day. Nice.

They finally busted a chop shop in the area. If the pricks had bothered to fingerprint my truck--it was an attempted car theft that turned into a car burglery--they might have done that sooner. They pretty much told me they weren't gonna do anything, and oh, btw, welcome to tunica. The funny thing is, the casinos don't get any better service. They only catch casino robbers by accident.
