I have a viewsat maxHD and it is running factory latest bin file with no third party modification. Can I be sued by Dish for using a viewsat? Seems they are after everybody using their receivers?

No, you can't be sued. There's not a lot of evidence that you could be sued even if it had pirate firmware on it.
